The Supreme Court of India released a 35-page preliminary report on June 3 about the Draft Regulations for Use of Artificial Intelligence (AI) in Courts, marking a significant acknowledgment of AI’s presence and its potential integration within judicial systems.
The proposed regulations emphasize “actively seeking opportunities” to deploy AI for improving access to justice, automating administrative functions, and enhancing operational efficiency.
Safeguards are outlined to prevent misuse of AI, ensuring it does not become the final arbiter of justice and addressing transparency and data protection concerns.
The report proposes a phased integration model allowing the top court and high courts the flexibility to adopt the rules based on their individual needs instead of a uniform approach.
It also details permissible and prohibited uses of AI, with restrictive measures against using personal data to train AI models and AI-generated contents in verdicts.
An oversight mechanism comprising an AI Committee at the Supreme and High Court levels, as well as a permanent, full-time body for policymaking and institutional oversight, is suggested.
All litigants will be informed about the use of AI in their cases, emphasizing transparency but restricting the information to instances where AI provides “material assistance.”
The report comes in response to recent judicial concerns regarding AI’s potential misuse, including reliance on AI-generated non-existent case precedents.
