  • On May 6, 2026, the chief negotiators of the Council of the European Union and the European Parliament agreed on a provisional draft of the Digital Omnibus package aimed at simplifying the digital legal framework with a focus on AI.
  • Significant changes are expected particularly for physical and industrial AI, including (high-risk) AI-equipped machines like autonomous robots.
  • New deadlines for high-risk AI systems were set: Rules will apply to stand-alone systems from December 2, 2027, and embedded systems from August 2, 2028.
  • AI system providers will need to register their AI systems in the EU database for high-risk systems and use special categories of personal data only when absolutely necessary.
  • National authorities must establish AI regulatory sandboxes by August 2, 2027, and implement transparency solutions for synthetically generated content by December 2, 2026.
  • The regulations will ban “nudifier” apps generating non-consensual sexual content or depictions of child sexual abuse by December 2, 2026.
  • The EU will remove the EU Machinery Regulation from the direct scope of the AI Regulation and empower the European Commission to set additional requirements for high-risk AI in machinery via delegated acts, set to be in force by August 2, 2028.
  • During the transition period, manufacturers can rely on harmonized standards, common specifications, or conduct risk assessments based on current technical standards to meet requirements. Greater individual responsibility, less double regulation, and stricter liability conditions are expected to impact manufacturers.
