Who: Plaintiff Ngozi Emerokwam filed a class action lawsuit against 8am LLC, doing business as DocketWise.<\/p>\n

Why: Emerokwam claims DocketWise failed to properly safeguard and secure the personally identifiable information (PII) of consumers during a recent data breach.<\/p>\n

Where: The class action lawsuit was filed in Texas federal court.<\/p>\n

A new class action lawsuit alleges DocketWise, an immigration and case management solution company, failed to properly safeguard and secure the personally identifiable information of more than 116,000 consumers during a recent data breach.\u00a0<\/p>\n

Plaintiff Ngozi Emerokwam claims DocketWise had both \u201clegal and equitable duties\u201d to protect and safeguard the private information of its customers from unauthorized access and intrusion.\u00a0<\/p>\n

Emerokwam further argues the data breach was due to DocketWise\u2019s \u201cnegligent and\/or careless acts and omissions\u201d and its \u201cutter failure to protect the plaintiff\u2019s and class members\u2019 sensitive data.\u201d\u00a0<\/p>\n

\u201cDefendant disregarded the rights of the plaintiff and class members by intentionally, willfully, recklessly or negligently failing to implement and maintain adequate and reasonable measures to ensure that the private information of the plaintiff and class members was safeguarded,\u201d the DocketWise class action lawsuit says.\u00a0\t<\/p>\n

Emerokwam seeks to represent a nationwide class of individuals residing in the United States whose PII was accessed and\/or acquired by an unauthorized party as a result of the data breach, including those who received notice of the data breach.<\/p>\n

Class action alleges DocketWise did not notify affected consumers fast enough<\/p>\n

Emerokwam claims DocketWise failed to notify consumers about the data breach in a timely fashion since it learned about the incident in or around October 2025 but only began notifying affected individuals about the incident on April 15, 2026.\u00a0<\/p>\n

\u201cDefendant acted with a knowing state of mind when it failed to notify the plaintiff and the class in a timely fashion about the data breach, thereby materially impairing their mitigation efforts,\u201d the DocketWise class action lawsuit says.\u00a0<\/p>\n

The data breach exposed PII, including consumers\u2019 names, Social Security numbers, non-numerical immigration information, governmental identification number and username and access information for a non-financial account, according to the DocketWise class action.\u00a0\t<\/p>\n

Emerokwam claims DocketWise is guilty of negligence, negligence per se, unjust enrichment, invasion of privacy and breach of fiduciary duty and third-party beneficiary contract.<\/p>\n

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual, nominal and consequential damages for herself and all class members.<\/p>\n

A consumer filed a similar class action lawsuit against Crunchyroll LLC over claims the company failed to protect the personally identifiable information of 6.8 million users during a March 2026 data breach.<\/p>\n
