The scale of cloud reliance and issues with cybersecurity<br \/>\nresults mean a risk of serious loss when things go wrong, so<br \/>\nbusinesses must be prepared contractually and operationally.<\/p>\n<p>What the NCSC says about the conflict in the Middle East<\/p>\n<p>Jonathon Ellison, director for national resilience at the<br \/>\nNational Cyber Security Centre (NCSC) said this week:<\/p>\n<p>In light of rapidly evolving events in the Middle East, it<br \/>\nis critical that all UK organisations remain alert to the potential<br \/>\nrisk of cyber compromise.<\/p>\n<p>The NCSC&#8217;s current assessment is that there is likely<br \/>\n&#8220;no current significant change&#8221; in the direct<br \/>\ncybersecurity threat from Iran. However, this could shift quickly.<br \/>\nAs the NCSC notes, there is &#8220;almost certainly a heightened<br \/>\nrisk of indirect cyber threat&#8221; for businesses based in the<br \/>\nMiddle East or who have supply chains there.<\/p>\n<p>The NCSC has published recommended actions for businesses, which<br \/>\nyou can access here.<\/p>\n<p>A reminder of your legal obligations<\/p>\n<p>UK cybersecurity law already imposes substantial duties on<br \/>\nbusinesses: assessing and managing cyber risk; implementing<br \/>\nappropriate technical and organisational measures, such as under<br \/>\nthe UK GDPR; maintaining operational resilience; and notifying<br \/>\nregulators of material incidents. Where relevant, you must also<br \/>\nnotify affected individuals.<\/p>\n<p>And these obligations are growing. The Cyber Security and<br \/>\nResilience Bill, when enacted, will expand the NIS framework<br \/>\nconsiderably. More critical suppliers and managed service providers<br \/>\nwill fall within scope. Regulators will gain stronger enforcement<br \/>\npowers and incident reporting timelines will tighten (see here for more details).<\/p>\n<p>And there&#8217;s more: if your UK business falls within NIS2<br \/>\nbecause you operate in the EU, you must meet that regime too.<\/p>\n<p>The upshot is that cybersecurity is not a box-ticking exercise.<br \/>\nIt requires ongoing attention at board level; robust contractual<br \/>\nprotections with suppliers and service providers; and a proactive<br \/>\napproach to incident preparedness.<\/p>\n<p>What you should do now<\/p>\n<p>In light of current events, we recommend that businesses take<br \/>\nthe following steps in addition to reviewing their IT posture:<\/p>\n<p>review your supply chain exposure: identify any suppliers,<br \/>\npartners, or cloud providers with operations or infrastructure in<br \/>\nthe Middle East. Assess their security posture and confirm<br \/>\ncontractual protections are in place.<\/p>\n<p>revisit your incident response plan: ensure your business has a<br \/>\ntested plan for responding to cyber incidents, including clear<br \/>\nescalation routes, regulatory notification procedures, and<br \/>\ncommunication protocols.<\/p>\n<p>brief your board: cyber risk is a governance issue.
