McGee: So, AI is obviously a huge<br \/>\nissue for our clients, both in terms of product development and<br \/>\nalso in the regulatory landscape. It is a very popular subject for<br \/>\nstate laws that are being rolled out across the<br \/>\ncountry\u2014usually consumer facing, but algorithmic use and AI,<br \/>\nSAS product-oriented regulations are starting to blossom throughout<br \/>\nthe state landscape.<\/p>\n<p>Amy S. Mushahwar: We are having privacy<br \/>\nstatutes creep and crawl across the country, just like data breach<br \/>\nstatutes did now 20 years ago, starting with the first California<br \/>\ndata breach statute.<br \/>\nSo, we are seeing an escalation of the amount of data<br \/>\nlaws\u2014AI, data disposal, still granular breach and more breach<br \/>\nobligations and more breach subject data\u2014and the scary thing<br \/>\nfor our clients is many of these laws require notification and<br \/>\nnotification on a stepped-up timetable.What is fascinating for me is the fact that we have moved beyond<br \/>\nwhat most firms are looking at, which is simple equal protection to<br \/>\nethical use, efficacy of the models, and whether or not the models<br \/>\nare hallucinating. Some security companies, like CrowdStrike, have<br \/>\nargued that just 150,000 records injected into your models and<br \/>\nwithin your model-training data, can create marginally different<br \/>\noutcomes. And can you imagine being a GC who all of a sudden<br \/>\nrealizes that the AI they are relying upon\u2014perhaps for<br \/>\nemployment, for lending, and for other very serious use cases and<br \/>\nperhaps even the distribution of benefits\u2014maybe that&#8217;s<br \/>\nnot working the way it should.We advise our clients that when dealing especially with more modern<br \/>\nsafety issues\u2014bullying, bulimia, true safety issues and<br \/>\ntrafficking, and we have clients who are actively assisting in some<br \/>\nof these areas\u2014they&#8217;re just an issue that it doesn&#8217;t<br \/>\nmatter whether or not federal enforcement occurs.
