Elon Musk has created a Spicy mode in Grok\u2026 where he talks of \u2018truth maximization\u2019, and therefore no filtering. So, Grok\u2019s design permitted unfiltered responses, making it prone to generating inappropriate content.\u201d Although xAI has since restricted this feature to paid users, Bindra calls the move inadequate, stating, \u201cThis is not a solution and in fact quite a brazen response to the whole problem.\u201d<\/p>\n<p>As outrage mounts, legal experts warn that India\u2019s existing laws offer only partial clarity. Advocate Prafull Bhardwaj, Supreme Court, and Founder of WhiteBand Legal, notes that \u201cAI-generated images fall under synthetic content regulations proposed in IT Rules amendments. They require mandatory labeling (10% display area for visuals), metadata watermarking, and user declarations.\u201d In addition, the IT Act and DPDP Act cover offences such as privacy violations, impersonation, and the misuse of personal data, particularly where identifiable features are involved.<\/p>\n<p>However, assigning responsibility remains complex. \u201cLegal responsibility primarily lies with users\/creators for intentional misuse. Platforms enjoy safe harbor under Section 79 of the IT Act if they follow due diligence requirements,\u201d Bhardwaj explains. That immunity, he adds, is not absolute. \u201cPlatforms lose immunity if they have actual knowledge of violations and fail to act\u2026 Courts have established that platforms \u2018enabling\u2019 infringement may share liability, creating a shared responsibility model.\u201d In cases like Grok, where the system itself allowed unfiltered outputs, this distinction becomes especially significant.<\/p>\n<p>Despite public expectations, platforms are not yet legally required to monitor content proactively. \u201cPlatforms mainly act reactively, removing unlawful content within 36\u201372 hours after complaints or court orders. The Shreya Singhal judgment clarified no general proactive monitoring duty exists,\u201d Bhardwaj says. Still, the regulatory mood is shifting. \u201cDraft rules increasingly expect preventive measures like watermarking, automated detection tools, and user verification,\u201d signalling a move toward stronger accountability frameworks.<\/p>\n<p>For victims of AI-generated abuse, legal remedies exist, but often demand persistence and legal literacy. \u201cAffected individuals can file FIR with cybercrime cells (cybercrime.gov.in), send legal notices for defamation\/cease-and-desist, report to social media platforms for takedown, and approach courts for injunctions, compensation, and criminal prosecution,\u201d Bhardwaj notes. He adds that deepfake-related offences may also fall under newer provisions of the Bharatiya Nyaya Sanhita, expanding the scope for law enforcement action.<\/p>\n<p>Cybersecurity expert Major Vineet Kumar, Founder &#038; Global President of CyberPeace, places the Grok controversy within a broader historical pattern of technological disruption. \u201cEvery innovation has both potential and danger\u2026 This also applies to artificial intelligence. It is a powerful tool, and like all great tools, how well it is used determines how much of an influence it has.\u201d He emphasises that the damage caused by manipulated images is far from abstract. \u201cThe harm is tangible to the victim\u2026 it is instantaneous, intimate, and lasting.\u201d For women and children, the psychological and reputational consequences can be devastating.<\/p>\n<p>The Grok image generation controversy, experts agree, is less about a single tool and more about a moment of reckoning.
