Midjourney Wants The Hollywood Studios That Sued It To Show The Court How They Use AI

Midjourney is seeking court-ordered information from Warner Bros. Discovery, Disney, and Universal Studios regarding their AI practices in hopes of establishing a fair use defense.
The companies previously sued Midjourney for alleged copyright infringement, particularly in generating images of copyrighted characters like Superman and Batman.
Midjourney argues that the training of their own AI on publicly available images constitutes fair use, and also claims that these companies use similar methods for their AI models.
Midjourney’s information requests include AI business plans, research reports, training datasets, model weights, and board meeting presentations.
A judge previously allowed the studios to withhold much of these AI-related details, requiring only information on “consumer-facing” AI applications.
Midjourney contests the judge’s partial redaction, aiming to show the studios’ own practices with copyrighted data to weaken the infringement claim against them.
This case could set a precedent for the types of evidence that may be admitted and considered in future litigation involving AI and copyright issues.
