Italy became the first EU Member State to adopt a comprehensive national framework dedicated to regulating Artificial Intelligence (AI) with the enactment of Law no. 132/2025 on October 10, 2025.
The National AI Law complements the EU AI Act by establishing sector-specific rules and defining the institutional architecture for overseeing AI in Italy, including designated authorities and sanctions.
Some provisions of the National AI Law are immediately applicable, while others, such as the training of AI systems, civil redress, and criminal sanctions, will require implementing decrees adopted by October 10, 2026.
The law ensures AI usage is “anthropo-centric,” respecting human rights and the principles in the Italian Constitution and EU law, and mandates transparency, proportionality, safety, and non-discrimination.
The law applies to several sectors including health, labor, intellectual professions, public administration, and the judiciary, with specific guidelines on the respectful, non-discriminatory use of AI within these areas.
Regulatory authorities responsible for AI include the Agency for Digital Italy (AgID) and the National Cybersecurity Agency, among others.
The law introduces criminal sanctions, including penalties for the unlawful dissemination of AI-generated content and enhancements to sentences for crimes committed using AI.
