NM AG announces legislation to protect victims of AI deepfakes

New Mexico Attorney General Raúl Torrez and State Representative Linda Serrato announced the “Artificial Intelligence Accountability Act” to curb the spread of harmful AI-generated images.
The legislation aims to mandate AI servers and social media platforms to embed markers in images to trace illegal content back to its source.
It imposes fines of up to $15,000 per day for non-compliance and creates civil liability for individuals who produce and reshare malicious deepfakes.
Victims of deepfakes can sue perpetrators and recover damages such as $1,000 per impression.
The act also proposes an additional year in a felony sentence if AI is used in connection with a felony.
The legislation announcement follows a case involving AI-generated child sexual abuse material, highlighting the urgent need for such regulation.
The full bill will be available for discussion and voting during the legislative session starting on January 20.
State leaders assert New Mexico’s right to regulate AI under the U.S. Constitution, despite federal efforts to discourage state-level regulations.
